By using the Services, such asplacing orders on the Site, you are agreeing to all of the Terms of Service.

Shun Fung Fruits reserves the right tomake changes to the Site, related policies and agreements, the Privacy Policyand this TOS at any time. You are advised to check the Site from time to timeto check the update or changes to the said policies and agreements, the PrivacyPolicy and the TOS.

You will need to register an account touse some of the Services available to you on the Site. In registering anaccount, you agree to provide information about yourself that is true,accurate, current, and complete in all respects. In using the Site, you agree to acceptresponsibility for all activities conducted through your account. You areresponsible for keeping your account and password secure. If you feel or suspectthat the security of your account has been compromised or if there isunauthorised use of your account, please contact us immediately.

Prohibitions and Failure to Comply

We may take actions against your accountfor activities including, but not limited to:

Shun Fung Fruits reserves the right toterminate any account at its sole discretion. We may send you an email toinform you of the termination of your account in such event.

Intellectual Property

All software and Content (which isdefined as, or includes, any text, audio or music, video, graphics,photographs, and image) are the intellectual property of Shun Fung Fruits andare protected by intellectual property and copyright laws and internationaltreaty provisions. The Site is for your personal and non-commercial use only.Any non-personal and/or commercial use of the Content is only permitted whenexpressly authorized by Shun Fung Fruits and/or its third party licensors. Youmay not distribute, reproduce, publish, sell or license any Content containedwithin the Site without prior consent or authorization of Shun Fung Fruits. Anysuch unauthorized actions may result in civil consequences or criminalpenalties.

Shun Fung Fruits reserves the right towithdraw or amend any item of the Services without notice. We will not beliable if for any reason the Site is unavailable at any time and for any period.

Third Party Links

The Site may include links to otherwebsites or resources that are not operated by Shun Fung Fruits. We have nocontrol over such sites and resources and we will not accept responsibility forthem or be liable for any loss or damage caused or alleged to be caused by orin connection with your use of them.

Shun Fung Fruits is not responsible forthe content or accuracy of any off-Site pages, which include but is not limitedto advertisers of the Site. Use of these external websites or resources will beat your own risk and subject to the terms of use and service contained withineach of such sites.

Eligibility to Purchase

In order to place orders with us, youmust meet our conditions of eligibility:

·      Be inpossession of a valid credit/debit card issued by a licensed bank acceptable toShun Fung Fruits for payment or be in possession of a valid PayPal account,unless you have opted to pay in cash on delivery; or

·      Providingpersonal and payment details that are warranted by you to be both valid andaccurate (email address, real name, phone number, billing information and otherrequested information as indicated on the Site).

In placing an order with us, youauthorize Shun Fung Fruits to process a charge or charges on your credit/debitcard or PayPal account in the amount of the total purchase price of your order.You also expressly authorize us to use personal information provided by you toperform appropriate anti-fraud checks such as credit checks and also to, wherenecessary, transmit or obtain information about you to or from third partiesincluding, but not limited to, credit reference or fraud-prevention agencies,which may keep a record of that information. Please refer to our Privacy Policyfor further information about how we use your data.

All orders are subject to stockavailability and confirmation of the order price. Items in your shopping basketwill be reserved for two hours and items will be emptied out of your shoppingcart after two hours.

The Site is for your personal use only.You may not purchase goods from the Site for reselling purposes or commercialexploitation.

Product Details

Shun Fung Fruits will endeavor to ensurethat the Content and the product descriptions on the Site to be accurate andcomplete as possible. We however do not warrant that Content and productdescriptions are accurate, complete, current or error-free.

While Shun Fung Fruits has tried toaccurately display the colors of products, the actual colors you see willdepend on your monitor and may not be accurate.

Pricing

Prices are shown on the Site in HongKong Dollars (HKD). Prices displayed on the Site at the time your order isaccepted will be honored except in the case of obvious error. Whilst we use ourbest endeavors to ensure that all prices appearing on the Site are accurate, wedo not guarantee that they are error-free and reserve our right to rectify anyerrors. If we discover an error in the price of any products that you haveordered, we will inform you as soon as possible and offer you the option ofreconfirming or cancelling your order. If we are unable to contact you, we willtreat the order as cancelled.

If your credit/debit card is notdenominated in Hong Kong Dollars (HKD), the final price charged in yourcurrency will be calculated by your issuing bank in accordance with theapplicable exchange rate on the day your card issuer processes the transaction.

Payment

We accept payments made by Visa,MasterCard and PayPal, bank-in slip submission as well as payments in cash ondelivery.

By placing an order using one of theabove Credit/Debit card and online payment methods, you confirm that theCredit/Debit card(s) or PayPal account used is yours or that you have beenauthorized by the owner to use it. If your card issuer refuses to authorizepayment to Shun Fung Fruits, we will not be liable for any delay ornon-delivery.

Cash on delivery is strictly restrictedfor orders under the value of 1500 Hong Kong Dollars.

Acceptance of your Order

Once you have entered your personal andpayment details and placed your order, we shall send you an email acknowledgingthe receipt of your order. This email is only a confirmation of receipt of yourorder and does not constitute an acceptance of your order. Your order will beaccepted and the contract between you and Shun Fung Fruits will be completedwhen we send you an email to confirm the goods have been dispatched to you.Only the goods listed in the confirmation email sent at the time of dispatchare included in the contract formed. All sales contracts are thereforeconcluded in Hong Kong SAR and are written in English.

Shun Fung Fruits reserves its right notto accept an order for any reason at its sole discretion. Such reasons include,but are not limited to, one of the following:

·      The productyou ordered is out of stock, or is withdrawn due to its failure to meet ourquality standards or due to the shipping restrictions applicable to one or allof the ordered items;

·      We identifya pricing or product description error;

·      We areunable to obtain authorization for payment; or

·      You do notmeet the eligibility criteria to purchase as set out in this TOS.

Our Customer Service team will contactyou as soon as possible if there are any problems with your order.

Shipping and Collections

Shun Fung Fruits insures each orderthrough transit up until it is delivered to you or is collected. You need tosign a confirmation of receipt of the products when the products are collectedand by doing so, you accept the responsibility for the products ordered fromthat moment on. If the recipient or collector is not the original purchaser, orin case of delivery of a gift, then you accept this signature as an evidence ofdelivery and fulfilment of your order by Shun Fung Fruits. You also accept theassociated transfer of responsibility in the same way.

Returns & Cancellation

Due to the perishable nature of ourproducts, we do not accept returns on any of our products. Please be advised tocontact customer care with questions regarding quality control.

We require 48-hour notice prior to yourscheduled delivery or pick up in order to cancel your order and you will beeligible for a full refund. Please contact our customer service email orhotline in order to cancel your order.

Voucher Codes & Gift Redemption

Voucher codes are only valid for ordersplaced online. Voucher codes are not valid in conjunction with any othervoucher code on a single purchase. Voucher codes entitle you, at the time ofpurchase, to a saving or gift redemption on a new order placed with Shun FungFruits. Shun Fung Fruits reserves the right to decline to accept orders that inits opinion, a voucher code is invalid for the order being placed. Vouchercodes are only valid on said products while stocks last and may be withdrawn atany time.

In the event of product returns, refundswill be given for the value of the original purchase, i.e. with applieddiscount. Vouchers are not transferable or redeemable for cash or credit. Touse a voucher code, you must enter it prior to completing the order on the“Shopping Cart” page.

Your Rights

Nothing in the TOS is intended to affectyour rights under the Law in Hong Kong SAR.

Liability

Views expressed in any media by thecompanies or third parties, whose products are sold on the Site or with whom weare associated, are their own. Shun Fung Fruits takes no responsibility for anysuch views as they do not necessarily reflect ours.

Shun Fung Fruits does not guarantee thatthe use of the Site and Services will be error-free or that the Site or theservers that make it available are free of viruses or other harmful components.We recommend all users of the Site to ensure they have up-to-date software,including anti-virus, installed.

Some events may happen beyond ourreasonable control, such as adverse weather. Under such conditions, Shun FungFruits will always do its best to aim at maintaining its Services but will notbe responsible for failing to meet any obligations in this TOS.

Indemnity and Waiver

At our request, you agree to compensateus fully and hold us, Shun Fung Fruits (including its officers, directors,agents, affiliates, licensors, and suppliers), harmless from and against allliabilities, claims, expenses, damages and losses, including legal fees,arising from any breach of the TOS by you. This includes the use of the Site byany other persons using your account caused by your action or inaction.

If you breach the TOS and we take noaction against you, it is no wavier for us to exercise our rights and remediesin any other situation where you breach the TOS.

Complaints

We have our complaints handlingprocedure that we will use to try to resolve any disputes when they firstarise. Please contact our Customer Service team for any order relatedcomplaints or comments.

Shun Fung Fruits respects theintellectual property of others. If you have reason to believe your work mayhave been used in the Site without your permission, please contact us followingthis complaints handling procedure.

Governing Law and Jurisdiction

The TOS, together with all our policiesand procedures, are governed by and construed in accordance with Hong Kong SARlaw. The relevant courts of Hong Kong SAR will have exclusive jurisdiction inthe event of any dispute or claim associated with these TOS.
